An immigration business plan differs from an investment business plan. An immigration business plan highlights the strengths of your business and the benefit to the United States, as well as proving compliance with United States Immigration laws. In contrast an investment business plan is often used for funding from banks and other lenders. The immigration officer will review the application along with the business plan, and make a judgement based on the likelihood the business is to generate employment and profit.
The E-2 Visa is valid to a maximum of 5 years, depending on the treaty with your country of citizenship. Provided you comply with the conditions of your visa, you may continue to extend your E-2 Visa indefinitely for up to 2 years at a time.
The E-2 Visa has very little limitations on what type of business you invest to as long as the above requirements are met. The E-2 visa can be used to buy an existing business or start a new business. Examples of E-2 businesses include hair salons, professional offices, bars/restaurants, hotels, fast food franchises and gas stations.
A question often asked is how much money must amounts to the “substantial and at risk.” There is no definite set amount for this. A consensus is that a minimum of $100,000 USD is sufficient depending on the type of business. For example, the substantial amount for an ice cream parlor would be much less than a hotel.
If you would like to start a business in the United States and are a citizen of an E-2 Treaty country, the E-2 visa is an ideal route for your immigration journey. The application process can be complicated and there may be other routes that may suit your needs better. We are happy to discuss your immigration options based on your specific goals and needs.
